Service of Process is the first phase in the legal system after a case has been filed. It is critical that the service be perfected by a Certified Process Server or a Server who has been appointed by the sheriff or the Court. Service of Process is important because the case will not proceed through the legal system until the defendant has been properly served. The process servers in Florida abide by Florida Statute 48. This statute dictates in what form an individual or a corporation must be served. After the completion of the service the Process Server will execute an affidavit of service which in turn is filed with the court in which the case is pending. Once the defendant has been served, the defendant has 20 days to answer the complaint. In the event the defendant does not answer the plaintiff can file a Motion for Default.
